Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and Documented ("we," "us," "our") governing your use of the Documented iOS app and the documented.co website (together, the "Service"). By downloading, opening, or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

Who can use Documented

You must be at least 18 years old and able to form a binding contract to use Documented. The Service is built for adults documenting their own parenting and is not directed at children.

What Documented is — and isn't

Not legal advice

Documented is a record-keeping tool. Nothing in the app, the website, or any guide, glossary entry, or export is legal advice, and using Documented does not create an attorney-client relationship. If you need legal advice about a custody matter, a protective order, or anything else, talk to a licensed attorney in your state.

No guarantee about court or admissibility

We designed Documented to produce a private, time-stamped, tamper-evident record, and features like RFC-3161 timestamps and export logs are meant to support that. But whether any specific entry, export, or record is admitted as evidence, and what weight it's given, is decided by a judge, applicable rules of evidence, and the facts of your case — not by us. We do not guarantee that any record created with Documented will be accepted, admissible, or persuasive in any court, agency, or proceeding, in any jurisdiction.

Tamper-evident, not tamper-proof

"Tamper-evident" means a change made after an entry is sealed leaves a detectable trace. It does not mean a record can never be altered, lost, or disputed. Treat Documented as one tool among several, not a substitute for your own judgment, contemporaneous notes, or your attorney's advice.

Your content

You own it

You own everything you create in Documented — entries, photos, video, voice recordings, receipts, message-thread captures, locations, and exports. Because your content is stored on your device (and, if enabled, synced only to your own private iCloud account), we never receive it and claim no rights to it.

You're responsible for it

You're solely responsible for the content you create and for making sure you have the right to capture and keep it. This matters in particular if you record calls, voicemails, or messages involving another person: recording-consent laws (sometimes called wiretapping or eavesdropping laws) vary by state and country, and some require every party's consent before you record a conversation. You agree to comply with the recording, privacy, and evidence laws that apply to you, and you agree not to use Documented to violate any court order (including custody or protective orders), harass or stalk another person, or violate anyone else's legal rights.

Sharing and exports

Exporting or sharing an entry — including with an attorney, mediator, court, or anyone else — is entirely your choice and happens only when you initiate it. Once you share or export content outside the app, we have no control over what happens to it, and these Terms don't govern what the recipient does with it.

Accounts, storage, and data loss

Documented does not require an account to use the app. Your record lives on your device and, if you enable iCloud, syncs to your own private iCloud account under Apple's terms — we don't operate servers that store your entries and can't recover them for you. Because of this, you are responsible for keeping your device secure and for enabling iCloud or your own backup method. We are not responsible for content that is lost, corrupted, or made inaccessible because of a lost, stolen, reset, or damaged device, a disabled or unavailable iCloud account, an uninstalled app, or any failure of Apple's services.

Third-party services

Documented depends on services we don't control, including Apple (iOS, iCloud, the App Store) and an independent RFC-3161 timestamp authority used to timestamp sealed entries. We are not responsible for outages, changes, or failures of these third-party services, or for their own terms and policies, which apply to your use of them alongside these Terms.

Purchases and subscriptions

If Documented offers a paid subscription or in-app purchase, it is billed and managed by Apple through your App Store account, under Apple's own terms (including its subscription, auto-renewal, and refund policies). We do not process payments or receive your payment details. Cancellations and refund requests are handled through Apple, not us.

Acceptable use

In addition to the restrictions above, you agree not to: reverse-engineer, decompile, or attempt to extract the source code of the app except as permitted by law; resell, sublicense, or use the Service to build a competing product; interfere with or disrupt the Service or its infrastructure (including the timestamp authority); or use the Service for any unlawful purpose.

Intellectual property

The Documented app, the documented.co website, and their design, text, graphics, logos, and software are owned by Documented or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes. All rights not expressly granted are reserved.

Additional terms for specific features

Some features — for example, tools built for attorneys — may come with additional terms specific to that feature. If those additional terms conflict with these Terms, the additional terms control for that feature only.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RECORD CREATED WITH IT WILL BE SUFFICIENT, ACCEPTED, OR ADMISSIBLE FOR ANY LEGAL, EVIDENTIARY, OR OTHER PURPOSE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCUMENTED WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING ANY RELIANCE ON A RECORD CREATED WITH DOCUMENTED IN A LEGAL, CUSTODY, OR OTHER PROCEEDING — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100. SOME JURISDICTIONS DON'T ALLOW THESE LIMITATIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.

Indemnification

You agree to defend, indemnify, and hold Documented harmless from any claim, damage, or expense (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or any law.

Termination

You may stop using Documented at any time by deleting the app. We may suspend or terminate your access to any account-based or shared features (if and when they exist) if we believe you've violated these Terms. Because your record lives on your device, termination of any account-based feature does not affect your ability to access content already stored locally or in your own iCloud.

Changes to these terms

We may update these Terms as Documented changes. If we make a material change, we'll update the effective date above and, where practical, note it prominently on this page. Continuing to use the Service after a change means you accept the updated Terms.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in California, and you and Documented each consent to personal jurisdiction and venue there.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver of it. These Terms are the entire agreement between you and Documented regarding the Service and replace any earlier agreements about it.
